Terms of Sale and Use

1. Purpose and scope

These Terms of Sale and Use (“Terms”) govern the sale of personalized QR code identification medallions, the NOX.PET subscription service (“Service”), and the use of the nox.pet website and related digital services, offered in Canada by NOX.PET.

By creating an account, placing an order, or using the Service, you confirm that you have read these Terms and the pre-contractual information on the site and accept them without reservation. Where you qualify as a consumer under the Quebec Consumer Protection Act (CQLR, chapter P-40.1) (“CPA”), the mandatory provisions of the CPA and applicable regulations prevail over any conflicting term in these Terms.

The Service is offered exclusively in Canada. Any order or use from another jurisdiction may be refused.

2. Merchant identification

NOX.PET is a sole proprietorship operating in Quebec, Canada. For questions regarding these Terms, orders, or the Service: support@nox.pet; for product or delivery complaints: contact@nox.pet.

3. Service description

NOX.PET is a technological service that voluntarily connects a person who has found a pet wearing a NOX.PET medallion with its owner, via a QR code engraved on the medallion and an associated online page.

The Service includes in particular:

• A personalized stainless steel, laser-engraved medallion (name, colours and fonts of your choice);
• Free shipping in Canada for eligible orders;
• Creation and management of one or more online profiles for your pets;
• Email alerts when the medallion is scanned;
• Scan history;
• Configurable privacy settings for the pet's public page.

NOX.PET is an obligation of means: recovery of a lost pet is not guaranteed. The Service depends in particular on a third party scanning the medallion and on technical means (smartphone, internet connection) being available.

4. Pricing and taxes

Prices are in Canadian dollars (CAD). Annual subscription: 29.99 $ CAD plus applicable taxes (GST and QST where applicable). Only the first medallion is included with the first subscription. Additional pet profile (slot): 9.99 $ CAD plus applicable taxes per year. Additional medallions: 9.99 $ CAD plus applicable taxes.

The total price including taxes and applicable fees is clearly displayed before order confirmation, in accordance with applicable distance-selling requirements.

5. Payment

Payment is due at the time of order. Payments are securely processed by Stripe (Visa, Mastercard, American Express). No card data is stored on our servers. For the annual subscription, renewal and charges are made each year until cancelled by you or by NOX.PET.

6. Shipping

• Processing: within 2 to 5 business days after payment validation.
• Delivery: estimated 5 to 10 business days in Canada from shipment. These times are indicative and may vary by region, season, and carrier conditions.
• Free shipping in Canada for eligible orders (subject to the terms displayed at checkout).
• NOX.PET is not responsible for delays attributable to the carrier or events beyond its control. In case of significant delay compared to the indicated timeframe, you may contact us for an appropriate solution.

7. Personalized products – Returns and exchanges

Medallions are personalized to your specifications (name, colours, fonts) and are non-refundable and non-exchangeable for change of mind, except in case of:

• manufacturing defect;
• engraving error caused by NOX.PET.

You are responsible for carefully checking the text and options before final confirmation of your order.

8. Defective products – Legal and contractual warranty

In case of manufacturing defect or engraving error caused by NOX.PET:

• Contact us at contact@nox.pet with your order number and a photo of the product.
• After verification, a replacement or correction will be provided free of charge.

Medallions also benefit from a one-year contractual warranty against manufacturing defects. The warranty does not cover normal wear, misuse, or loss. Consumer rights under the legal warranty (CPA and Civil Code of Quebec) remain applicable.

9. Digital services and subscription

Digital services (profile creation, medallion activation, Service access) are deemed provided and used upon activation. They are non-refundable after activation, except where required by law or due to a defect attributable to NOX.PET.

You may cancel your subscription at any time via your account or by contacting us. Cancellation takes effect at the end of the already-paid period. No proportional refund is granted for the unused period unless required by law or accepted by us as an exception.

10. Service deactivation and data retention

At the end of the already-paid subscription period if you cancel, or immediately upon expiration for non-payment or any other cause leaving the subscription inactive: the pet's public page is no longer accessible to the public (including people scanning the medallion); alerts and other active scan-related features are disabled; access to the dashboard and Service features is suspended until the subscription is valid again, subject to minimal access required to renew where applicable.

Information relating to pet profiles and, where applicable, your account is retained for a maximum of thirty (30) days from that deactivation to allow reactivation of the Service. After that period without resubscribing or reactivating, it is permanently deleted or processed in an equivalent manner, unless legal retention applies (e.g. accounting records or dispute).

For account deletion requests, data processing is also governed by the privacy policy; unless a more specific rule applies, data is deleted within a maximum of thirty (30) days, subject to the same legal exceptions.

11. Limitation of liability

NOX.PET cannot guarantee recovery of a lost pet; the Service facilitates contact but depends on third-party behaviour and technical means.

To the maximum extent permitted by applicable law, NOX.PET's liability to you for any claim related to the Service, products, or site is limited to the amount actually paid by you in the twelve (12) months preceding the claim, except in case of gross or intentional fault or damages that cannot be limited by agreement under the law.

NOX.PET does not replace microchipping, an active GPS device, pet insurance, or a professional pet recovery service.

12. Electronic acceptance and evidence

Acceptance of these Terms by click or validation during registration or checkout constitutes acceptance within the meaning of applicable electronic contract laws. NOX.PET's electronic records are proof of orders and communications, subject to your right to adduce evidence to the contrary.

13. Governing law and jurisdiction

These Terms are governed by the laws of the Province of Quebec and applicable federal laws of Canada, including the Consumer Protection Act and the Civil Code of Quebec.

For any dispute arising from these Terms or the commercial relationship, the parties submit to the exclusive jurisdiction of the courts of the Province of Quebec, judicial district of Montreal, without prejudice to the consumer's right to bring proceedings in any other court of competent jurisdiction under the law.

14. Language

The site and Terms are offered in French and English. In case of discrepancy, the French version prevails.

15. Modifications and contact

NOX.PET reserves the right to modify these Terms. Modifications apply to orders and use after their publication on the site. For ongoing contracts, a substantial change may be notified to you; your continued use of the Service after it takes effect may be deemed acceptance unless the law requires explicit consent.

16. Lawful use and prohibited content

It is strictly forbidden to use NOX.PET for unlawful or reprehensible purposes under applicable law.

Users must not publish or display on medallions (engraved text), animal profile pages, or any other part of the service any content that is hateful, discriminatory, pornographic, violent, defamatory, that incites hatred or violence, or that is otherwise unlawful or contrary to public order and good morals.

NOX.PET reserves the right to suspend or ban any account and to refuse access to the service in the event of a breach of these rules, without prejudice to legal remedies and without obligation to refund the remaining period.
